Because the project generates no revenue and pursues no commercial interests, an immediate fee-incurring legal cease-and-desist would be disproportionate under the established case law of DACH jurisdictions (see, among others, BGH, judgment of 12 December 2013, I ZR 131/12). The project maintainer takes responsibility seriously and will respond to any substantiated complaint without delay:
- the disputed content will typically be removed or changed within 48 hours,
- a binding declaration to cease and desist will be issued voluntarily where an infringement actually exists,
- the costs of an initial legal letter will be rejected as unfounded because, absent prior direct contact, such costs are neither necessary nor proportionate.
We therefore ask for understanding that we will reject legal fee notes that are issued without prior direct contact as a matter of principle.
